1. Acceptance of Terms

Welcome to PeekUp! By accessing or using our mobile application (the "App") and our ride-hailing services (the "Services"), you agree to comply with and be bound by the following Terms of Service ("ToS"). If you do not agree to these terms, please do not use our App or Services.

 

2. Definitions

In this ToS, the following definitions apply:

  1. "PeekUp," "we," "us," or "our" refers to PeekUp Philippines Corporation the provider of the App and Services.

  2. "Passenger" or "User" refers to individuals who use the App to request and book rides.

  3. "Driver" refers to individuals who provide transportation services through the App.

  4. "Ride" refers to the transportation service provided to Passengers by Drivers.

  5. "Account" refers to the personal account created by Passengers to use the App and Services.

 

3. Eligibility

  1. Passengers must be capable of entering into an agreement. By using our App and Services, you represent and warrant that you meet these eligibility requirements.

 

4. Account Registration

  1. Passengers are required to create an Account to use the Services.

  2. You agree to provide accurate, complete, and up-to-date information during the registration process.

  3. You are responsible for maintaining the confidentiality of your Account login credentials and for all activities that occur under your Account.

5. Booking and Ride Services

  1. PeekUp offers a platform that allows Passengers to request rides from Drivers.

  2. Passengers can book rides through the App by specifying the pick-up and drop-off locations.

  3. The App will provide information about the Driver, including their name, photo, and vehicle details.

  4. Passengers can view the estimated fare before confirming the ride request.

 

6. User Conduct

  1. Passengers are expected to treat Drivers and other users with respect and courtesy.

  2. You agree not to engage in any unlawful, disruptive, or harmful behavior while using our Services.

  3. Prohibited activities include harassment, fraud, vandalism, and any violation of our policies.

 

7. Payments and Pricing

  1. Passengers agree to pay for rides based on the fare determined by the App at the time of booking.

  2. Pricing may include the base fare, time rate, distance rate, and additional fees.

  3. Payments can be made through the App using specified payment methods.

 

8. Cancellation and Refunds

  1. Passengers can cancel rides before the Driver arrives at the pick-up location.

  2. Cancellation fees may apply in certain cases, as detailed in our Cancellation Policy.

  3. Refunds for canceled rides will be processed in accordance with our Refund Policy.

 

9. Privacy Policy

  1. PeekUp's privacy practices are governed by our Privacy Policy, available within the App.

  2. Passengers consent to the collection, use, and sharing of their personal information as described in the Privacy Policy.

10. Intellectual Property

  1. All content and intellectual property in the App and Services belong to PeekUp.

  2. Passengers are granted a limited, non-exclusive, and non-transferable license to use the App for personal purposes.

 

11. Liability and Disclaimers

  1. PeekUp shall exercise due diligence of a good father of a family in the selection, accreditation, and supervision of their TNVS partners and drivers. This responsibility imposed upon PeekUp attaches from the time that the said TNVS is online and offers its services to passengers.

 

12. Indemnity

  1. Passengers agree to indemnify and hold PeekUp harmless from any claims, damages, or losses arising from their use of the Services.

 

13. Termination

  1. PeekUp reserves the right to suspend or terminate Passengers' access to the App and Services for violation of these terms or any unlawful activity.

 

14. Governing Law and Jurisdiction

  1. This agreement is governed by the laws of the Philippines.

  2. Any disputes shall be resolved through arbitration in accordance with the rules of the Land Transportation Franchising and Regulatory Board.

 

15. Amendments

  1. PeekUp may update these terms at any time.

  2. Passengers will be notified of changes, and continued use of the App constitutes acceptance of the revised terms.
